Terms of Service & End User Licence Agreement — Skylight
These documents are final and take effect when Skylight is publicly released on the App Store. The app is currently in final testing, and a small number of features described here are still being completed.
These Terms are an agreement between you and EEA MEDIA (eenmanszaak), De Skatting 14, 8621 BW Heeg, the Netherlands, KvK 93005520 ("Skylight", "we", "us"). Contact: support@skylight-app.org.
By downloading or using the Skylight app, you agree to these Terms. If you do not agree, do not use the app.
These Terms are a licence agreement between you and us — not with Apple. Apple has no obligation to you under these Terms, but Apple has certain rights described in section 19.
1. What Skylight is
Skylight is an iOS app that generates astrology readings from birth details you provide. Some features (your chart, transits, monthly scores) are computed on your device. AI-generated readings are produced by sending your details and question to a third-party AI provider (Anthropic) via our server; the resulting text is returned to and stored on your device. Skylight is provided for entertainment and personal reflection.
2. Who may use Skylight
You must be at least 13 years old to use Skylight. If you are under 18 (or the age of majority where you live), you may use Skylight only if a parent or guardian has reviewed and agreed to these Terms on your behalf and supervises your use, including any purchase. In the EEA and UK, the feature that sends free-text questions to our AI provider is intended for users 16 and over.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
3. Your licence
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use Skylight on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. All rights not expressly granted are reserved.
You may not: (a) copy, modify, distribute, sell, rent or lease the app; (b) reverse engineer, decompile or attempt to extract source code, models, or the prompts we send to the AI provider, except where law permits despite this restriction; (c) use bots, scripts or automated means to access the service or scrape outputs; (d) circumvent the free-tier limits or any technical restriction; (e) use Skylight to build or train a competing product.
4. AI-generated readings — read this section
Skylight's readings are generated by an artificial intelligence system, not a human. You are informed of this here, at the point of use in the app, and on our paywall.
- Readings are non-deterministic: the same question can produce different answers at different times.
- Readings can be inaccurate, incomplete or simply wrong, and may occasionally contain statements that sound confident but have no factual basis.
- Readings are not medical, psychological, legal, financial, or other professional advice, and are not a substitute for it. Do not rely on a reading for any decision of consequence — health, money, relationships, work, or anything else that matters.
- Astrology has no scientific basis for predicting events. Skylight is for reflection and entertainment.
- If you are in distress or crisis, Skylight is not the right place to seek help. Please contact a qualified professional or a local support service.
5. Free tier and subscriptions
Free tier. Skylight currently includes 5 AI answers (lifetime) and 3 months of timeline history at no charge. We may change free-tier limits prospectively.
Skylight Premium is an auto-renewing subscription, currently USD 7.99 per month or USD 39.99 per year (local pricing and tax are shown in the App Store before purchase).
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription automatically renews for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel at any time in your Apple Account subscription settings, or via the Manage Subscription button inside the app. Deleting the app does not cancel a subscription.
- Prices may change; Apple will notify you and, where required, seek your consent before a price increase applies.
Apple is the seller. Your purchase contract is with Apple, not with us. Refunds, billing disputes, and any statutory right of withdrawal or cancellation are handled through Apple (reportaproblem.apple.com). Nothing in these Terms limits any statutory refund or withdrawal right you have; where such a right exists, it is exercised through Apple's process.
6. Your inputs, and data about other people
Your inputs. You give us permission to process the details and questions you enter for the sole purpose of operating Skylight, including transmitting them to our AI provider to generate your reading. How data is handled is described in our Privacy Policy at skylight-app.org.
The People feature. When you add another person, use a nickname or first name only — never a full name — and only add someone if you are entitled to: because they have agreed, or because you are their parent or guardian, or you otherwise have a proper basis. Do not add anyone who has asked you not to. You promise ("warrant") to us that every entry you make complies with this section, and you — not we — are responsible for the entries you make.
7. Who owns the readings
As between you and us, your readings belong to you. We assign to you any rights we may hold in the reading text generated for you, and we claim no ownership over it. You may use your readings freely for personal purposes. This does not give you any rights in the app, our brand, our prompt designs, or our systems, and it does not permit the commercial use described in section 8.
8. Acceptable use
You may not use Skylight to: (a) harass, stalk, profile, or make decisions about another person; (b) provide astrology or advisory services to others commercially, whether paid or unpaid at scale; (c) generate content that is unlawful or infringes another person's rights; (d) probe, overload, or interfere with the service or its security; (e) misrepresent readings as human-authored or as professional advice.
9. Our intellectual property and attributions
Skylight, its brand, design, software, and prompt engineering are owned by us or our licensors and protected by law.
Skylight includes third-party components:
- Location data from GeoNames (geonames.org), licensed under Creative Commons Attribution 4.0 (creativecommons.org/licenses/by/4.0). This attribution is a condition of the licence and also appears in the app.
- astronomy-engine, © Don Cross, licensed under the MIT License; the licence text is reproduced in the app's licence screen.
10. Third-party services
Skylight depends on services we do not control: Anthropic (AI generation), Apple (distribution and payment), RevenueCat (subscription management), and Vercel (hosting). We are not responsible for their availability. If a third-party provider changes or withdraws a service, features of Skylight may change or become unavailable; where that materially affects a paid subscription, your remedies are through Apple's refund process and any statutory rights you hold.
11. Availability and changes to the service
We provide Skylight with reasonable skill and care, but we do not promise uninterrupted or error-free operation, and we may modify, add, or remove features. We will not remove core paid functionality mid-subscription-period without the remedies described above being available to you.
12. Warranties and your statutory rights
Except as expressly stated in these Terms, Skylight is provided "as is" and we disclaim all implied warranties to the extent the law allows.
But nothing in these Terms affects rights the law gives you that cannot be waived. If you are a consumer in the EEA or the UK, you have statutory rights regarding the conformity of digital content and services (including under the EU Digital Content Directive as implemented in your country), and nothing in these Terms — including sections 12, 13 and 14 — limits or replaces them. If Skylight is not as agreed, you may have legal remedies against us regardless of anything written here.
13. Liability
To the extent permitted by law:
- Our total liability to you for all claims arising out of or relating to Skylight in any 12-month period is limited to the greater of (a) the amounts you paid for Skylight in the 12 months before the event giving rise to the claim, or (b) EUR 100.
- We are not liable for indirect or consequential loss, loss of profits, loss of data caused by factors outside our reasonable control, or damage resulting from reliance on a reading contrary to section 4.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or deliberate recklessness (opzet of bewuste roekeloosheid), or for anything else that cannot be excluded under the law that applies to you.
14. Your responsibility to us (indemnity)
If you are a consumer in the EEA or the UK: if a third party brings a claim against us because you deliberately and unlawfully misused Skylight — including knowingly entering another person's data without any right to do so — you are responsible for the loss we suffer as a direct result, to the extent the law of your country permits.
If you reside in the United States or elsewhere outside the EEA/UK: you will defend and indemnify us against third-party claims, damages and reasonable costs (including legal fees) arising from your breach of sections 6 or 8 or your unlawful use of Skylight.
15. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms and, where the breach is curable, fail to cure it within a reasonable time after notice. Termination for your breach does not, by itself, entitle you to a refund, except where statutory rights provide otherwise; any refund is processed through Apple. You may stop using Skylight at any time and cancel any subscription through Apple. Sections 7, 9, 12–14, and 16–21 survive termination.
16. Changes to these Terms
We may update these Terms. For minor changes we will update the version and date. For material changes we will give at least 14 days' notice in the app before they take effect. If you continue using Skylight after that date, the updated Terms apply; where the law of your country requires your active agreement to a material change, we will ask for it, and if you do not agree you may stop using Skylight and cancel through Apple before the change applies to you.
17. Governing law and where disputes are heard
These Terms are governed by the law of the Netherlands. If you are a consumer, you additionally keep the protection of the mandatory consumer laws of the country where you live, and nothing in this section deprives you of it.
Disputes may be brought in the courts of the Netherlands. If you are a consumer in the EEA or the UK, you may always bring a claim in the courts of your own country, and we will bring any claim against you only there.
If you reside in the United States, section 18 applies to you instead of court proceedings, except as it says otherwise.
18. United States residents — arbitration and class waiver
This section applies only if you reside in the United States. Please read it; it affects your rights. You can opt out — see 18.6.
18.1 Informal resolution first. Before starting arbitration, you and we agree to try to resolve any dispute informally: send a written description of the issue to support@skylight-app.org and allow 60 days for resolution. This is a precondition to arbitration.
18.2 Agreement to arbitrate. Any dispute arising out of or relating to Skylight or these Terms that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section 18, notwithstanding section 17. The arbitrator decides all issues except those this section reserves to a court.
18.3 Small claims carve-out. Either party may instead bring an individual claim in small claims court if it qualifies there.
18.4 Costs. We will pay AAA filing, administration and arbitrator fees beyond an amount equal to your local small-claims filing fee, unless the arbitrator finds your claim frivolous.
18.5 Class action waiver. Disputes will be arbitrated only on an individual basis. Neither you nor we may participate in a class action, class arbitration, or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, not in class arbitration.
18.6 Your right to opt out. You may opt out of this section 18 entirely by emailing support@skylight-app.org within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
18.7 Coordinated filings. If 25 or more similar demands are filed by or with the assistance of the same or coordinated counsel, the parties agree the AAA shall administer them in batches of up to 50, with a single set of fees per batch, before proceeding.
19. Apple — required terms
The following terms are required by Apple and apply to your use of Skylight obtained from the App Store:
(a) Acknowledgement. These Terms are between you and EEA MEDIA only, not Apple. EEA MEDIA, not Apple, is solely responsible for Skylight and its content.
(b) Scope of licence. Your licence is limited to use on Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
(c) Maintenance and support. EEA MEDIA is solely responsible for providing any maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support for Skylight.
(d) Warranty. In the event of any failure of Skylight to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Skylight, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are EEA MEDIA's responsibility.
(e) Product claims. EEA MEDIA, not Apple, is responsible for addressing any claims by you or any third party relating to Skylight or your possession and use of it, including: (i) product liability claims; (ii) any claim that Skylight fails to conform to legal or regulatory requirements; and (iii) claims under consumer protection, privacy, or similar legislation.
(f) Intellectual property. In the event of any third-party claim that Skylight or your possession and use of it infringes that third party's intellectual property rights, EEA MEDIA, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
(g) Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
(h) Developer contact. Questions, complaints or claims: EEA MEDIA, De Skatting 14, 8621 BW Heeg, the Netherlands — support@skylight-app.org.
(i) You must comply with applicable third-party terms of agreement when using Skylight.
20. Age signals and platform compliance
Where an app store or operating system provides us with an age category or parental-consent signal under applicable law (for example, U.S. state app store accountability laws), we use that information only to comply with those laws, transmit it securely, do not use it for any other purpose, and delete it when no longer needed for compliance. We rely on the app store's age determination where the law permits.
21. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about Skylight. If any provision is found invalid, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the business, who will be bound by them. These Terms are drafted in English; if we provide a translation, the English version controls to the extent the law allows. Headings are for convenience only.
